Physical Therapy Continuing Education: Spinal Stabilization – Is It All About Transverse Abdominus?

In more recent times, physical therapy continuing education courses focusing on training the muscles of the spine have placed a huge emphasis on Transverse Abdominius. There are differing views on the importance of this muscle.

We recently interview a spine rehab expert to get his thoughts. This is what he said.

Interviewer: Well, if we talk a little more specifically about your work, can you describe your research findings on the roles of the different muscles in spine stabilization?

Spine Rehab Expert: I knew we had to get to that one. Well, you know, we’ve heard so much about muscles like how important it is to correct transverse abdominis pathology, and the multifidus is so important and whatnot. I think there’s really a disconnect between the science and clinical practice. These muscles are no more important than any other muscles. I’ve already mentioned a couple of minutes ago that if you don’t have quadratus lumborum you can’t walk, and yet in the clinical discussion you never hear, well, very rarely would you hear a clinician talk about QL.

If you’re going to carry an object, if you’re going to plant a foot on the soccer pitch or the football field and change direction and run, if your pelvis collapses on the swing way side you’ll be a very ineffective sportsman and you’ll load up your back. So, there’s an example where quadratus lumborum is absolutely crucial.

For lifting, when you go to Russia and you study their lifting culture, they put huge emphasis on latissimus dorsi. Very rarely do I hear lifters in North America, when they’re pulling a bar, trying to bend the bar, external rotate through the shoulders and pull with latissimus dorsi, strapping and stiffening their back down to the sacrum, for example.

The role of the gluteal complex is enormous for hip extension, and particularly those who have back problems. We know those muscles tend, not in all but in a lot of people, tend to get inhibited.

So, the answer to the question is all of the muscles are important when it comes to spinal stability. They form a guide wire system that allows the spine to bear tremendous loads. It allows the spine to store and recover elastic energy when they’re throwing an object or kicking or punching, for example. Or it might be just to simply pick your groceries out of the back of the car. So, all muscles are important. How they play together is crucial. You have to recognize these patterns, measure it, and train it appropriately. But, this emphasis on single muscles, well, I think that’s dying out now as you probably have detected as you go to different meetings.

Interviewer: Right. So, just to clarify on that, we know that the transverse abdominis, for example, is not the whole answer to spinal stability. Some research –

Barters and trades of goods and services represent an increasingly significant percentage of our economy, especially among small businesses, many of which have turns to one of the oldest forms of commerce in hopes of weathering the recession. One obvious reason is that bartering allows an individual to exchange goods or services for something you that they need, but can’t pay for. But it also allows them to get rid of extra inventory or take advantage of “down time” in exchange for reducing their cash outlay for business expenses. In this economy, bartering is a smart move.

However, as the IRS has warned recently, bartering is still considered business and is therefore taxable activity:

“The fair market value of property or services received through barter is taxable income. Bartering is the trading of one product or service for another. Usually there is no exchange of cash. However, the fair market value of the goods and services exchanged must be reported as income by both parties.”

This rule covers a variety of “transactions” that many, including savvy business owners, might not think twice about: the local barber trading a haircut for a free meal at a friend’s mom and pop restaurant; an artist offering up a painting in exchange for a month’s worth of dog walking? Again, this exchange is considered generated reportable income – for both parties in the barter transaction.

In an effort to help those who fall into this category, the IRS has highlighted the following four facts about bartering that small business owners understand come tax time:

Barter Exchange

According to the IRS, a barter exchange functions primarily as “the organizer of a marketplace where members buy and sell products and services among themselves.” Applying equally to products produced and sold from a physical space or through the Web, this exchange is bound to the rules governing Form 1099-B, Proceeds from Broker and Barter Exchange Transactions, meaning it must be submitted annually to a barter’s clients or members as well as to the IRS.

Barter Income

In an effort to eliminate any confusion over what is meant by barter income for tax purposes, the IRS has stated, “barter dollars or trade dollars are identical to real dollars for tax reporting.” In other words, the income from this activity should be recorded in the same manner as other forms of income — on the appropriate tax return for the barter’s particular type of business. Generally, this number should correlate to the fair market value of the product or service. A good rule of thumb: It’s the price that a “willing buyer” would pay for the goods or services from a “willing seller.” In other words, what would the cost of that piece of art be on the open market? How much would you normally charge to do cut someone’s hair? Those answers determine the fair market value of the transaction.

Taxes

Another given is that the bartering income is taxable in the year that it was actually performed. The IRS is also careful to point out that bartering may yield certain liabilities for income tax, self-employment tax, employment tax, or excise tax. A small business that barters barter may incur ordinary business income, capital gains or capital losses, or you may have a nondeductible personal loss.

Reporting

The reporting requirements for transactions that fall within the category of bartering can hinge on what kind of bartering activity has taken place. Generally, this type of business income on Form 1040, Schedule C Profit or Loss from Business, or other business returns such as Form 1065 for Partnerships, Form 1120 for Corporations, or Form 1120-S for Small Corporations.

Record Keeping

The bottom line is that, whether or not tangible money changes hands, a small businesses that barter must treat this activity as they would any other business transaction. That means they must also maintain good records of all bartering transaction — both what is bartered away and what is received.

When to Consult a Tax Professional

Businesses that regularly barter should consider consulting a CPA, IRS enrolled agent or other registered tax agent to learn more about the tax requirements, especially when they are uncertain about reporting requirements or how to best value their services. The 2007 mortgage meltdown and subsequent collapse of the financial system brought about significant change on practically every front. The impact of these events on the tax system was both far-reaching and substantial, as most any enrolled agent or registered tax return preparer can testify. One aspect of this change included an at-times dizzying number of new tax breaks in the form of credits and deductions designed to help both alleviate the financial strain on average Americans and stimulate the economy in the process. One such credit, the Home Buyer Tax Credit, is so popular that it occupies a focal point in tax CPE and EA CPE, enrolled agent continuing education courses that enrolled agents take to maintain certification.

Below is a summary of what enrolled agents need to know about this credit to ensure their clients receive the full tax credit offered by the government.

Qualifying for the home buyer tax credit

Contrary to popular opinion, both first-time homebuyers and long-time owners are able to apply for a credit. If the house was purchased on November 30, 2009, to qualify taxpayers must not have owned their homes since December 1, 2006. The earliest date to qualify for this credit is January 1, 2009.

To qualify for the credit as long-time homeowners, taxpayers must have owned their existing home for any five-year period during the eight-year period ending on the date of purchase of the new home. The earliest date of purchase to qualify for this credit is November 8, 2009.

For either credit, if the date of purchase is in May or June 2010, taxpayers are required to verify that they entered into a contract to buy the house before May 2010. Below is a summation of the required documentation.

Restrictions

Even when taxpayers qualify as first-time homebuyers, or as long-time homeowners, and you have purchased a home within the permitted time frame, they still may not qualify for the credit. Taxpayers will not qualify if any of the following scenarios apply:

Purchased the house after November 6, 2009, and the price of the house is more than $800,000.

Modified adjusted gross income is $95,000 or more ($170,000 if married filing jointly) and the home was purchased before November 7, 2009. A phase-out of the credit begins with a MAGI of $75,000 (or $150,000).

Modified adjusted gross income is $145,00 or more ($245,000 if married filing jointly) and the home was purchased after November 6, 2009. A phase-out of the credit begins with a MAGI of $125,000 (or $225,000).

Another individual claims the applicant as a dependent on their tax return.

Purchased the house after November 6, 2009, and the buyer was under the age of 18 on the date of purchase.

Is a nonresident alien.

The house is located outside the US.

The house is sold or ceases to be the main residence before the end of the year in which it was purchased.

The house is a gift or is acquired through inheritance.

The house is acquired from a relative or a related corporation or partnership.

The amount of the credit.

First-time homebuyers qualify for a credit of 10% of the purchase price up to a maximum of $8,000 ($4,000 if married filing separately). Long-time residents qualify for a credit of 10% of the purchase price up to a maximum of $6,500 ($3,250 if married filing separately). Again, when the modified adjusted gross income exceeds a certain level, the credit will be phased out until it is eliminated entirely.

Claiming the credit

Since the IRS requires a slew of documentation, taxpayers hoping to claim the homebuyer tax credit must file federal tax returns on paper through the mail need to print the paperwork and send it in.

Below is a step-by-step guide for claiming the credit for clients:

1. Complete the revised Form 5405. First confirm the taxpayer qualifies for the credit, and determine the amount of the credit.

2. Collect required documentation. Gather Form HUD-1 Settlement Statement or other settlement statement outlining the names and signatures of all parties to the sale, the property address, the price, and the date of purchase. If the taxpayer does not have a settlement statement (as in the case of a newly-constructed home), collect the certificate of occupancy and attach it.

If a taxpayer is under contract but has not taken occupancy of the house by the time their taxes are filed, include pages from the signed contract, including the signatures and names of all parties, the property price, the address, and the contract date.

If a taxpayer qualifies as a long-time homeowner, include Form 1098 (Mortgage Interest Statement), property tax records, or the homeowners’ insurance records. Remember, the forms must cover a full consecutive five-year period within the …
